Terms of Service

Welcome to the Phoenix Bots — Phoenix Guardian, Phoenix Tickets, and Phoenix Universal Protectors (collectively, the "Bots" or the "Service") — provided by Dustshader ("we", "us", "our"). This page also serves as the Terms of Service for the Phoenix Guardian web dashboard at phoenix-guardian.com, through which Phoenix Guardian specifically is configured. By adding or using any of the Bots on your Discord server, or by accessing the dashboard, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Bots or the dashboard.

1. Acceptance of Terms

By adding or using any of the Bots on your Discord server, or by logging into the dashboard, you agree to these Terms and any additional terms incorporated by reference. We reserve the right to modify these Terms at any time, and your continued use of the Bots or dashboard after changes are posted constitutes acceptance of those changes. You are responsible for periodically reviewing this page for updates.

2. Eligibility

You must meet Discord's own minimum age requirement (13 years old, or the higher minimum age required in your country) to use the Bots or dashboard. If you use the Service on behalf of a Discord server, you represent that you have the authority to do so.

3. User Responsibilities

You agree to use the Bots and dashboard in compliance with all applicable laws, rules, and regulations, and in compliance with Discord's own Terms of Service and Community Guidelines. You must not use the Bots for any illegal activity, including harassment, spamming, or any form of cybercrime, and you must not attempt to exploit bugs, create unnecessary load, reverse engineer, or bypass restrictions in the Bots or dashboard.

4. Server Administrator Responsibilities

If you configure a Bot for your server — including automod word lists, logging channel destinations, warning issuance, role assignment rules, ticket configuration, or any other setting — you are solely responsible for those configuration choices and for how the resulting features are used within your community. We do not review, endorse, or take responsibility for any server-specific configuration, moderation action, or content decision made using tools the Bots provide.

5. Access for Support, Compliance, and Proper Functionality

By adding a Bot to your server, you authorize Dustshader to: (a) generate invite links to your server through the Bots' backend, and (b) access the dashboard for your server, including viewing and editing its configuration, where reasonably necessary to provide support, verify the Bot is being used correctly and in compliance with these Terms, diagnose or fix issues, or ensure the Bots' proper functionality.

6. Bot and Dashboard Functionality

The Bots and dashboard are provided "as is" and "as available," with no warranties of any kind, either express or implied. We do not guarantee that the Bots or dashboard will be error-free, uninterrupted, or free from security vulnerabilities. We reserve the right to modify, suspend, or discontinue any part or all of the Service at any time, with or without notice, and to add or remove features as we see fit.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA PROCESSED BY THE SERVICE WILL BE ACCURATE OR COMPLETE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DUSTSHADER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, REVENUE, OR PROFITS, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGE TO YOUR SYSTEM, SERVER, OR ACCOUNT CAUSED BY THE BOTS, WHETHER DUE TO ERRORS, INTERRUPTIONS, DATA LOSS, OR OTHERWISE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT, IF ANY, YOU PAID US FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Waiver of Claims

To the fullest extent permitted by applicable law, you agree not to bring any claim, demand, or legal action against Dustshader arising out of or related to your use of the Service, and you release Dustshader from any such claims. This waiver does not apply where, and only to the extent that, applicable law does not permit such a waiver — for example, claims that cannot be waived as a matter of law remain unaffected by this section.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dustshader and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination and Discontinuation

We reserve the right to suspend, restrict, or shut down any or all of the Bots or the dashboard at any time, for any reason, with or without notice. You may stop using the Service at any time by removing the relevant Bot from your server and/or revoking its Discord OAuth authorization in your Discord settings. Upon termination or discontinuation of the Service, whether by you or by us, we have no obligation to provide, export, or preserve any data associated with your use of the Service.

12. Data and Privacy

By using the Service, you consent to the collection and use of information as described in our Privacy Policy. We do not sell your personal data to third parties. We are not obligated to delete, export, or otherwise act on data requests upon termination of the Service or otherwise, except where required by applicable law.

13. Third-Party Services and Links

The Service depends on and may link to or integrate with third-party platforms, including Discord and our infrastructure providers. We do not control these third parties and are not responsible for their availability, content, security, or policies. You use any third-party service at your own risk.

14. Force Majeure

We will not be liable for any failure or delay in performance of the Service caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, telecommunications or internet failures, or actions of third-party providers (including Discord).

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts. Resolution of any dispute will be governed by, and limited to the extent permitted by, this section and Sections 8 and 9 above.

16. Severability

If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dustshader regarding the Service, and supersede any prior agreements regarding the Service.
